Thomas Middelhoff fails with appeal against detention – Spiegel Online

Hamm – Thomas Middelhoff remains in custody. The Hamm Court on Thursday rejected an appeal against detention of the 61-year-old as unfounded. There was still a flight risk, judged the 5th Criminal Division.

In support of the Court referred to, inter alia, the fine imposed on the manager imprisonment of three years, but also on further criminal investigations and the creditors it raised millions receivables.

The Senate insisted on a consideration of all the circumstances it is likely that the manager would deprive the criminal proceedings other than that he would keep his disposal. Middelhoff see due to the proceedings against him even no chance to build a new economic existence in Europe, but over Concerning operative business contacts outside Europe. In addition, he had after his arrest initially concealed the District Court of the existence of a second passport with a valid visa for the People’s Republic of China.

The former head of the now bankrupt previous Karstadt’s parent company Arcandor was sentenced on November 14 from Essen district court for embezzlement and tax evasion to three years in prison and arrested in the courtroom. The court acquitted the former head of the now bankrupt previous Karstadt parent company Arcandor guilty after six months of negotiations, the infidelity in 27 cases and tax evasion in three cases. The damage caused by Middelhoff estimated the court to around 500,000 euros.

The presiding judge John Smith justified the arrest warrant against Middelhoff time with a flight risk. The main reason may be the amount of the penalty of imprisonment, the residence abroad and the unclear situation of the professional manager.

With the surprisingly harsh judgment, the Court was only slightly remained under the demand of the prosecutor’s office. In his two-hour verdict the judge said the six-month trial had confirmed the allegations of the prosecution to a large extent.

Middelhoff however, appealed against the judgment. It is therefore not yet final. The Manager has always denied the charges against him.
