Karlsruhe – the dictionary publisher Langenscheidt has the trademark dispute to the color yellow won against a competitor. This allowed the color no longer use, such as the Federal Court today ruled in Karlsruhe.
The highest German civil court justified this by saying that the consumer due to the color the two brands could confuse. The Supreme Court saw a “high grade” goods and character similarity (AZ: I ZR 228/12).
Langenscheidt had 2010 color mark yellow for his bilingual to register printed dictionaries. Because of language learning software Rosetta Stone manufacturer also uses a yellow tint in the website, in advertising and carton packaging, the Munich-based publisher had been an infringement of its trademark claims. Langenscheidt Rosetta Stone had therefore sued for failure and damage, and get 2012 right before the Higher Regional Court of Cologne. In contrast, Rosetta had filed an appeal. This has now rejected the defendant’s costs
The color question employs the Supreme Court under a different aspect. Rosetta Stone has also requested the deletion of the Langenscheidt color mark . Whether the Federal Patent Court rejected the right to examine the Supreme Court in a second process. On October 23, Karlsruhe will also negotiate (document number C Eg 61/13).
