Supermarkets – Edeka, Tengelmann-Fusion is an embarrassment for all concerned – Süddeutsche.de

  • The Higher Regional Court of Dusseldorf has to pop the planned merger of Edeka and Tengelmann.
  • Two six-on-one meetings between the CEOs and Sigmar Gabriel would have led to a potential bias of the Minister.
  • Edeka will examine how the group can take legal action against the decision -. but the court has no revision approved
From Varinia Bernau Michael Kläsgen and Michael Bauchmüller

The decision came as a surprise. And it is clearly and unambiguously. The Higher Regional Court Dusseldorf holds the ministerial approval by Economy Minister Sigmar Gabriel (SPD) for botch. In this form so far well-off process, the Court annulled a ministerial permit. The merger of supermarkets Kaiser’s Tengelmann and Edeka is for the time being burst, Gabriel disgraced and possibly the preservation of thousands of jobs at risk

The court order -. Bitter irony of history – exactly the decision brought that Tengelmann Chef Karl-Erivan Haub has claimed a few days ago in his wet research Art. He introduced virtually an ultimatum. By the end of this month he wanted clarity – of course in a very different sense. “There can be no ending story,” he noted a week ago and thus criticized the sluggish negotiations the unions with Edeka, on which he has hardly any influence. Fearing yet possible concessions to the employees of the remaining 430 stores of Kaiser’s Tengelmann, which should be adopted by Edeka.

The ruling is resounding slap

The agonizingly long discussion about yes or no merger now seems to have been in vain. “This decision has stirred up great feeling,” Haub said on Tuesday. We regret this turn, “especially in view of our almost 16 000 people.” Indicates Haub thus smashing the supermarket chain, as it already did often? Indeed, it is unclear how to proceed. Individual profitable supermarkets could persist. But the rest? Kaiser’s Tengelmann makes for years loss. Finding a buyer for the supermarkets, now is not a simple

The

decision to establish the Düsseldorf judges to 33 pages, is a slap in the face -. not only for the company Tengelmann, which, after the Bundeskartellamt the merger was prohibited, had turned to the economy Minister. But also for the Minister himself. The judges throw Gabriel before partiality. So a bid of rival Rewe had already in November, as had been the first time negotiated with all stakeholders on ministerial approval, submitted to that guaranteed the preservation of all jobs

Why Tengelmann wants

Tengelmann CEO Karl-Erivan Haub will lead the company into the Internet age. But as any necessary sale of supermarkets is still questionable. And now? From Varinia Bernau more …

The Ministry of economy has all these accusations out of hand. Interviews with applicants were “within the framework of such a procedure customary possible and allowed,” it said of Gabriel House. At a hearing of all the ministers have even participated themselves – be the first economy minister in such a process at all. Incidentally it go “to the existence of many thousands employees and their families”

Then -. And the poor pay the supermarket jobs – Gabriel had always stressed. Regardless of the employees is important at a time, in the “people feel that their concerns and needs are in the policy is no longer heard.” Just the though now live again in uncertainty.
